GENERAL CONDITIONS OF SALE
Nordic Lullaby di Fringuellino Laura, VAT 10758150964, is the owner of the site http://www.nordiclullaby.com (hereinafter "Nordic Lullaby").
Preconditions
By using the services available on www.nordiclullaby.com, the General Terms and Conditions of Contract described (hereinafter in the "Conditions" section) are fully and unreservedly accepted.
These Conditions apply to all orders placed, by any means provided below, for all items and services offered on www.nordiclullaby.com.
Acceptance of the general conditions of sale
This contract is a distance contract pursuant to art. 50 and ss. Of Legislative Decree 6 September 2005, n. 206 ("Consumer Code"). The Contract which concerns the sale of movable property between Nordic Lullaby di Fringuellino Laura and the consumer (hereafter "Customer") must be considered concluded with the acceptance, even partial, of the order by Nordic Lullaby. Acceptance will be sent by Nordic Lullaby to the e-mail address communicated by the Customer when placing the order. By placing an online order, the Customer declares to have read all the information provided to him during the purchase procedure, to have understood them and to fully accept these Terms and conditions of payment as provided by Nordic Lullaby.
These Conditions and, in particular, the information referred to in art. 52 of the Consumer Code, as provided by Nordic Lullaby, will remain valid and effective until modified and / or integrated by Nordic Lullaby. Any changes and / or additions to the Conditions will be effective from the date they are communicated to the public and will apply to sales made from that date. The latest updated version of the Conditions is the one available on the Nordic Luallaby website. Once the purchase procedure is completed, the Customer is required to print or save an electronic copy of these General Conditions of Sale.
Purchase method
The Customer can only purchase the Products present in Nordic Lullaby's electronic catalog (hereinafter the "Products" or the "Product") when placing the order and viewable online at www.nordiclullaby.com, as well as described in the relevant information sheets. It is understood that the image attached to the descriptive sheet of a Product may not be perfectly representative of its characteristics, but may differ in color, size, accessories possibly present in the figure.
The correct receipt of the order is confirmed by Nordic Lullaby by means of an e-mail reply, sent to the e-mail address communicated by the Customer during the purchase. The message reproduces all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.
In case of non-acceptance of the order, Nordic Lullaby guarantees timely communication to the customer.
Nordic Lullaby reserves the right to cancel orders considered unreliable without notice. In this circumstance, if the Customer has made the payment and this has already been credited, Nordic Lullaby will proceed with the immediate reversal of the total amount of the order.
By purchasing through the Nordic Lullaby website, the Customer will receive a summary e-mail from Nordic Lullaby, with which he will be informed that his purchase proposal is being processed and will be considered accepted, unless otherwise communicated by e-mail or sent by Nordic Lullaby within 3 (three) calendar days from the receipt of the summary e-mail.
Once this term has elapsed, the Agreement via the Internet is to be considered completed.
Methods and delivery costs
For orders placed on www.nordiclullaby.com, the goods can be sent to home by express courier.
All orders for products in stock are delivered abroad within 3-7 working days from receipt of payment, while for items arriving directly from the manufacturer, delivery times can range from 7-20 working days. For Nordic Lullaby shipments use the DHL express courier.
In the event that in the same order there are Products available for immediate delivery together with Products to be ordered, the order will be processed in a single solution upon arrival of all the Products not immediately available. Nordic Lullaby however, reserves the right to process orders even partially if some items are delayed and the 12 working days should be exceeded.
The aforementioned delivery times are for indicative purposes only and, although they are usually respected, Nordic Lullaby does not assume any commitment or guarantee of compliance with the same.
In no case, therefore, direct and / or indirect damages for delayed delivery can be charged to Nordic Lullaby.
In the case of multiple purchases, at the same time, by multiple Customers, Nordic Lullaby reserves the right to verify, upon receipt of the order, the availability of the Product and, failing that, to promptly communicate the non-acceptance of the order sent. .
From the day of departure of the package, you will receive the tracking number associated with your order (tracking number) to your e-mail address, with a link that automatically returns you to the DHL website where you can check the status of your shipment.
Delivery takes place from Monday to Friday, except holidays, in the normal working hours (9-13 14-17)
We recommend to the kind Customers to report the address where you are physically present, alternatively opt for the address of the workplace, or of another family member etc., carefully filling in all data ( house number, surname on the bell, extension number, staircase etc.) to avoid unpleasant inconveniences.
Upon delivery of the Products by the courier, we advise the Customer to verify that the number of packages corresponds to that indicated in the transport document and that the packaging is intact and does not present any damage or obvious alterations. Any damage to the packaging and / or the product or the mismatch in the number of packages must be immediately contested by the Customer who must affix the word "CONTROL RESERVE" in writing on the copy of the document that remains to the courier, specifying detailed reason: possible type of damage, parcel number etc ... Once the courier's document has been signed, the Customer will not be able to make any objection regarding the characteristics of what has been delivered. Nordic Lullaby is not responsible in any case for damages not reported following the above procedure.
Any problems concerning the physical integrity, correspondence or completeness of the Products received must be reported within 7 days of delivery by contacting Nordic Lullaby who will proceed to open a case of damage, theft or anomaly necessary for the replacement of the goods.
In case of damaged goods, in order to verify the presence and extent of the damage to the physical integrity of the Products caused by the transport, everything must necessarily be documented through a photograph in digital format, to be attached to the communication addressed to Nordic Lullaby together with the scan the courier's newsletter with the reserve specifications. In any case, no responsibility can be attributed to Nordic Lullaby in case of delay in processing the order or in delivering what has been ordered.e absence of the recipient, leaves a notice of "delivery attempt" with the information necessary to be able to contact him and agree on a new delivery or collection of the goods at the NEXIVE branch.
Shipping fees
For each order the Customer will be required to pay the delivery costs which will depend on the destination, weight and volume of the products. The shipping costs will be clearly highlighted in the cart when the order is placed, in the case of multiple products the costs are calculated based on the sum of the weight of the Products.
Shipping costs
We draw the attention of the kind Customer on the days when the courier, according to its terms of service, does not make deliveries: on Saturdays and Sundays; on midweek holidays; during the holiday closing period established by the category of road hauliers; on days and times when traffic on urban and / or suburban roads is prohibited by administrative provision; on days when, due to local custom or for the provision of the Public Administration, warehouses and / or offices, shops and companies are closed due to force majeure or fortuitous events.
Customer's right of withdrawal
Pursuant to the Consumer Code, if the customer is a consumer, he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty. Products ordered specifically for the customer are exempt.
The right of withdrawal is not allowed to legal persons (e.g. companies, retailers, etc.) and to natural persons who act for purposes related to their commercial activity.
To exercise the right of withdrawal, the customer must simply send a simple communication to that effect to Nordic Lullaby, within 10 days from the date of receipt of the goods. The communication must be sent by registered letter with acknowledgment of receipt or by telegram, addressed to: Nordic Lullaby di Fringuellino Laura, via Giacomo Leopardi 2, 20020 Magnago (MI).

Once the notice of withdrawal has been received, Nordic Lullaby will promptly communicate to the Customer the instructions to be followed for returning the Products, which will take place within 10 working days of receipt of the return instructions; the costs of delivery will be entirely borne by the customer, likewise the cost incurred for the first delivery shipment, which will not be refunded.
The right of withdrawal is however subject to certain conditions:
- the law applies to the Products purchased in their entirety; it is not possible to exercise withdrawal only on part of the purchased Products;
- shipping costs (both outward and in a possible return) are always charged to the customer;
- Nordic Lullaby Products are sold in special packages, in some cases of particular value and value with a specific processing; these packagings are considered an integral part of the Products. Therefore, in order to regularly exercise the Customer's Right of Withdrawal, the purchased good must be intact and returned in the original packaging received, complete in all its parts (including packaging and any documentation and accessory equipment to limit damage to the original packaging ).
- the shipment, up to the certificate of receipt at Nordic Lullaby, is under the complete responsibility of the Customer;
- in the event of damage to the goods during transport, Nordic Lullaby will promptly notify the Customer;
- Nordic Lullaby is not liable in any way for damage, theft or loss of the returned Products;
- upon arrival at Nordic Lullaby, the Product will be examined to assess any damage or tampering not caused by transport. If the original packaging and / or packaging are damaged, the Customer will lapse from the Right of Withdrawal as indicated below.
For products returned intact, Nordic Lullaby will refund the customer the full amount already paid, by bank transfer, within 14 days of returning the product. The customer will promptly provide the bank details on which to obtain the refund (Code ABI - CAB - Current Account of the invoice holder).
The Customer will lapse from the Right of Withdrawal due to the lack of the essential condition of integrity of the Products (packaging and / or its contents), in cases where Nordic Lullaby ascertains:
- the lack or damage of the external packaging;
- the lack of the original internal packaging;
- the absence of integral elements of the Product (accessories, parts);
- damage to the product for reasons other than its transport.
In the event of forfeiture of the Right of Withdrawal, Nordic Lullaby will return the purchased good to the Customer, charging the shipping costs to the Customer and will not proceed with the refund of the price paid.
Request to replace an item
The replacement procedure of a Product or its component may be activated as a result of one of the following hypotheses:
- a Product other than the one the Customer ordered and therefore not present in his order was incorrectly sent by Nordic Lullaby. If this hypothesis occurs, the Customer must refrain from opening the package and immediately report the error to Nordic Lullaby by email in order to allow the appropriate checks;
- the Product purchased is not functional from the first use;
- the Product is incomplete in some components listed on the Site.
In each of the cases listed above the shipping costs will be borne by Nordic Lullaby and the return shipment will be made by express courier.
Return of goods
The Customer who decides to request the replacement of a Product should contact Nordic Lullaby as soon as possible at the e-mail address info@nordiclullaby.com before organizing the return shipment. Nordic Lullaby reserves the right to inspect the Product before accepting the return or not. If all the required conditions are respected, the Customer will replace the Product in the shortest possible time. In the event that there is no availability of the Product to be replaced, Nordic Lullaby will refund the price of the Product within 10 days of receipt of the Product, by bank transfer, upon communication of the customer's bank details.
If the return conditions as provided for in this article are not respected, the returned Product will not be accepted and the Customer may choose to have the purchased Product returned, taking care of the return costs. In case of refusal of shipment Nordic Lullaby reserves the right to retain the Product and the corresponding amount.
Guarantees
All Products sold by Nordic Lullaby are covered by the manufacturer's conventional warranty and by the 24-month warranty for lack of conformity, pursuant to Legislative Decree 24/02 on the subject of sales and consumer goods warranties. To take advantage of warranty assistance, the Customer must keep the purchase invoice.
The 24-month warranty pursuant to Legislative Decree 24/02 from the moment of delivery and applies to the Product that has a lack of conformity, provided that the Product itself is used correctly, respecting its intended use and what provided in the attached technical documentation. This guarantee is reserved for the private consumer customer, meaning as such the natural person who buys the goods for purposes not related to his professional activity, or makes the purchase without indicating in the order form a VAT number reference. In the event of a lack of conformity, Nordic Lullaby provides, at no cost to the Private Customer, to restore the conformity of the Product by repairing / replacing or reducing the price, until the contract is terminated. The Private Customer forfeits his rights under the Guarantee if he does not report by registered letter with return receipt. or via PEC to Nordic Lullaby the lack of conformity within two months from the date on which he discovered the defect.
In the event that, for any reason, Nordic Lullaby is unable to return a Product under warranty (restored or replaced), it may proceed at its discretion to return the entire amount paid by the Customer or to replace it with a Product of equal or superior characteristics.
No damage can be claimed from Nordic Lullaby for any delays in making repairs or replacements.
In cases where the application of the guarantees provides for the return of the Product, the goods must be returned by the complete Customer in all its parts (including documentation and accessory equipment).
Nordic Lullaby will not be considered in default of its obligations if the fulfillment is delayed due to a Force Majeure event. Force Majeure means any event beyond Nordic Lullaby's reasonable control, such as: natural events, storms, floods, fires, riots, sabotage acts, trade ban, strike, suspension of energy, equipment failure, delays in transportation due to the same causes listed above as a cause of Force Majeure, orders from civil authorities, deeds, regulations, ordinances, from any governmental authority, acts of war, interruptions of Internet service, acts or omissions of the Customer. The contractual deadlines are postponed for the time necessary to overcome the consequences of a Force Majeure cause. In the event that the Force Majeure event continues for more than 1 month, both parties will be able to terminate the contract and the parties will agree in good faith on the consequences of such termination.
Conformity of products
Nordic Lullaby declares that all the Products in its catalog and marketed comply with the standards and approved according to the European Union legislation. Nordic Lullaby is not liable in the event of any discrepancy with respect to the standards of countries not belonging to the European Union and / or their failure to homologate the Products themselves in said countries.
Suspension of the service
Nordic Lullaby reserves the right to temporarily suspend, without any prior communication, the provision of the Services for the time strictly necessary for the necessary and / or appropriate technical interventions to improve the quality of the same Services.
Nordic Lullaby may, at any time, interrupt the provision of the Service if there are justified security reasons or breaches of confidentiality.
Customer obligations
The customer declares and guarantees the following:
- to be a consumer according to the provisions of art. 3 of the Consumer Code;
- to be of age;
- that the data provided by the same for the execution of the Contract are correct and true.

Jurisdiction
This sales contract is concluded in Italy and regulated by Italian law. For the solution of any controversy deriving from the conclusion, interpretation and execution of this Contract, if the Customer is a consumer, the territorial competence is that of the reference hole of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Forum of Busto Arsizio.
